Hammer collects information depending on how you engage with our products and services (for example, whether you are a prospective purchaser of a vehicle, or an operator of an auto dealership).

Hammer’s Role in Information Collection

Hammer provides an online software platform to facilitate the gathering and collection of information that auto dealers or other entities may use in making the decision whether to extend financing to you for the purchase of a vehicle. You acknowledge and agree that except for the limited role of providing an  information gathering and collection platform, Hammer has no involvement in the process of extending financing to you. Without limiting the generality of the foregoing, you acknowledge and agree that Hammer is not a "financial institution" as that term is defined under applicable law.

Information We Collect

Hammer gathers information from you when you provide such information using the credit application feature of the Hammer services (the "Credit Application"). This information includes your name, address, employment information, e-mail address, Social Security number, income, and financial information.

Use of Information

Hammer may disclose the information you submit via the Credit Application with (a) the dealership from which you have specified interest in receiving financing, or (b) to comply with any applicable law or regulation requiring such disclosure, or any subpoena or court or other governmental order that Hammer determines in its discretion to be valid.

Hammer takes reasonable steps that are designed to safeguard the information you submit. We store and encrypt your information in such a way that our employees cannot view it; only authorized employees at the dealerships can view it after proper authentication.

To further protect your information, we automatically delete it from our system after 90 days, or after such other period of time as you may have instructed us through means we provide through our services.

Revisions

This policy applies to each instance in which you submit information via the Credit Application. The terms of this policy that apply to one submission of information will not carry over to any other instance in which you may submit information, but in those other instances, the terms of this policy as it reads at that time will apply. Accordingly, Hammer reserves the right to periodically revise this policy in its sole discretion.

Information submitted via the Hammer "Credit Application" is also subject to the Hammer Privacy Policy. Please read that document to learn what information Hammer collects and how your information is used, disclosed, and protected.

Questions

Questions about the financing process — including timelines, updates, and information about why certain information is collected and what is done with it — are best directed to the specific dealership you are working with. Hammer undertakes no responsibility or liability to provide any such specific information to you in the process of using the Credit Application.

Hammer does not share personally identifiable information with third parties for their marketing purposes unless you provide us with consent to do so.
